Marella Caracciolo Inheritance Case
The Marella Caracciolo inheritance case concerns the widow of Gianni Agnelli, who died in 2019, and originated from an investigation by the Turin public prosecutor's office into unpaid inheritance taxes: the three siblings John, Lapo and Ginevra Elkann were charged with fraud against the State and jointly filing a false tax return, with the case centring on the Swiss residence declared by their grandmother.[1] On the civil side, since 2020 their mother Margherita has been contesting the validity of the 2004 inheritance agreement.[5]
In September 2025 the prosecutor's office accepted a one-year probation proposal for John Elkann.[1] On 15 December 2025, judge Giovanna De Maria rejected the agreement between the defence and the prosecution and ordered that he be formally indicted.[2]
The Court of Cassation subsequently rejected Elkann's appeal; the charge was reclassified as fraudulent tax declaration and the preliminary hearing was postponed to 11 September 2026, while the charges against Lapo and Ginevra Elkann were dropped.[3] On that date the preliminary investigations judge rejected the mother's request to join the proceedings as a civil party against him, allowing it only with regard to the forgery charges against the accountant Gianluca Ferrero and the notary Remo Moroni.[4] No ruling has yet been issued.
